COLD IMMERSION PARTICIPANT AGREEMENT & LIABILITY WAIVER

1. Voluntary Participation
I voluntarily choose to participate in a cold immersion experience provided by Be That Kind LLC dba Testimony Tub (“Testimony Tub”). I understand that cold immersion is a physically and mentally demanding activity that exposes the body to very cold temperatures. I may stop at any time.

2. Assumption of Risk
I understand that cold exposure can involve risks, including but not limited to: increased heart rate, changes in blood pressure, lightheadedness or dizziness, shortness of breath, nausea, muscle cramps, panic response, slip/fall injuries, and potential aggravation of pre-existing medical conditions.
I freely and knowingly assume all risks, known and unknown, associated with participating in this experience.

3. Medical Acknowledgment
By signing this waiver, I confirm that:

  • I am in a physical condition that allows me to safely participate.

  • I do not have any medical conditions that would make cold immersion unsafe for me, including but not limited to: serious heart conditions, uncontrolled high blood pressure, a history of fainting, major circulatory disorders, cold urticaria, severe asthma, or pregnancy.

  • If I am unsure, I have consulted a physician prior to participating.

  • I understand that Testimony Tub staff are not medical professionals and do not provide medical advice.

I agree that I am solely responsible for my own physical well-being during this activity.

4. Participant Conduct & Safety Rules
I agree to:

  • Follow all instructions given by Testimony Tub staff.

  • Enter and exit the tub slowly and carefully.

  • Inform staff immediately if I feel unsafe, unwell, or wish to stop.

  • Never participate under the influence of alcohol, drugs, or impairing substances.

I understand that failure to follow safety instructions may increase the risk of injury.

5. Release of Liability
In consideration of being permitted to participate, I hereby release, waive, and discharge Be That Kind LLC dba Testimony Tub, its owners, staff, contractors, host location, event organizers, property owners, and all associated parties from any and all liability, claims, demands, or causes of action arising from injury, illness, loss, damage, accidents, or participation in cold immersion, including use of equipment and conditions of the premises, at any event, private booking, gym/studio activation, corporate wellness experience, retreat, or off-site location where the service is offered, except where caused by gross negligence or willful misconduct.

6. Indemnification
I agree to indemnify and hold harmless Testimony Tub and the host location from any claims brought by me or any third parties arising from my actions, participation, or failure to follow instructions.

7. Photo & Video Release (Optional)
I understand I may be photographed or recorded during my participation. I can indicate below whether I grant permission for Testimony Tub to use my image for marketing and promotional purposes.

8. Consent to Electronic Signatures
I agree that my electronic signature (typing my name) is valid and binding.
